Painting company and owner-operator sentenced over a quarter million for transporting, dumping hazardous waste
One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)
The defendants in this case are the owner/operator of a paint company and the company itself, co-defendants facing charges under the Clean Water Act (CWA) and the Resource Conservation and Recovery Act (RCRA). Investigators found the defendants poured out hazardous waste into the public sanitary sewer in violation of the Clean Water Act. Further, the corporate defendant was confronted and convicted on charges for transporting hazardous materials in violation of the RCRA.
The individual defendant pled guilty and was convicted on a single count, negligent violation of the CWA. The company entered a guilty plea to one count violation of CWA and one count of violation of RCRA, knowingly transport without a manifest. The owner of the company was sentenced to 6 months probation and a federal fine of $2500. The corporation got 36 months probation and a federal fine of $33,478. The most significant part of this sentencing is the restitution payment, the majority directed to California Department of Toxic Substances Control (DTSC).
