The defendants in this case are a registered wastewater treatment facility operating in Orange County, California and its President/owner. Investigators presented information to the federal district court in California detailing the permit held by the defendants for the processing of non-hazardous industrial wastewater. The permit allowed the defendant to receive the identified wastewater stream, to remove pollutants and discharge the appropriately treated effluent into the Orange County public wastewater system.
The discharge permit issued by Orange County Sanitation District requires the discharging entity to perform testing and monitoring of discharges to ensure compliance with federal law regulating what the County is permitted to handle and release. The defendant was sentenced for violation of the Clean Water Act, knowing violation as it was determined that the discharged material had not been tested, type and concentration of contaminants to the regulated public wastewater facility unknown.
Federal Fine: $50,000; Probation: 36 months
