One of twenty-four criminal prosecutions under the CWA in the state of Florida
$2.5 million in restitution ordered for dumping construction waste in Pensacola Bay
Three individuals involved in the construction of a Florida bridge were charged and found guilty of dumping the excess rebar and excess concrete and cement, along with cut-off bridge pilings into East Bay and Pensacola Bay. The principal defendant faced three charges of negligent violation of the Clean Water Act and ordered to pay restitution for the clean-up and associated costs. Two defendants were charged with a single count of negligent violation of the CWA. Each of the three defendants received three years of probation.
Total federal fines: $3000; total restitution: $2,500,000; total probation: nine years.
