One of twenty-four criminal prosecutions under the CWA in the state of Florida

Hiding the contaminant underground – overwhelmed and under-sized septic field diverted wastewater to Dryman Bay

When a septic drainage field could not keep up, the manager in charge acted in violation of the CWA, instructing employees to install an underground pipe diverting excess effluent into US waters.

The Sarasota Florida yacht club development’s wastewater treatment plant was designed to discharge treated sewage effluent onto drain fields. When the drain fields backed up, the defendant chose to install a bypass in violation of the plant’s discharge permit. The underground pipes diverted unsightly excess wastewater into municipal stormwater drainage channels leading to Dryman Bay.

Georgia Spills we are Tracking Oct 31 – Nov 6, 2022

  • -Oct 26 estimated 668,400 gallons of sewage spilled into Snapfinger Creek in Decatur – Dekalb County – as a result of an 8” line break.

Chattahoochee Watershed

  • -Aug 26, 2022: callers reporting multiple tanker trucks dumping unknown liquid on a field off Sandy Flats Rd in Cleveland (White). Callers expressed concern about leaching into the groundwater and local wells.
  • -Georgia EPD file is closed as of Nov 2, 2022, investigator to the site found no evidence of erosion, noted more than adequate buffers from the field to the creek. Water testing upstream and downstream of the dumping site was tested in Chateen Creek showing no violations of water quality parameters.
