Hiding the contaminant underground – overwhelmed and under-sized septic field diverted wastewater to Dryman Bay
When a septic drainage field could not keep up, the manager in charge acted in violation of the CWA, instructing employees to install an underground pipe diverting excess effluent into US waters.
The Sarasota Florida yacht club development’s wastewater treatment plant was designed to discharge treated sewage effluent onto drain fields. When the drain fields backed up, the defendant chose to install a bypass in violation of the plant’s discharge permit. The underground pipes diverted unsightly excess wastewater into municipal stormwater drainage channels leading to Dryman Bay.
