The owner operator of a septic pumping service hired to clear residential septic systems of sludge and sewage, and performing clean-outs of commercial septic systems sludge, sewage, chemicals and grease held a permit to dump these specific waste materials at a Publicly Owned Treatment Plant (POTW) site equipped to receive and treat the combination of waste material collected under the particular permit. In March 2010, the owner-operator discharged combination grease and sludge waste directly into the county sanitary sewer system in contravention of permit. The reason presented to the court was to save time, so the truck could complete more jobs each day, and avoid paying the tipping fees.
