Environmental Crimes: One of twenty-four historic criminal prosecutions under the Clean Water Act in the state of Florida

Tire shop owner dumps 20,000 used tires into the canal, sentenced with restitution and community service

Historic Case: Fiscal Year: 1990, CR_371 (Florida)

The owner of a tire company in West Palm Beach was convicted on a guilty plea for violation of the Clean Water Act, knowingly discharging pollutants into canal waters of the USA.

An information was filed charging the West Palm Beach tire shop with knowingly discharging pollutants into West Palm Beach Canal.  Federal district court heard that automobile tires were removed from the shop twice a week and dumped into the canal over a period of two years, 1986 and 1987.

The defendant was sentenced to restitution payable to Southern Florida Water Management for the clean up of the canal; three years of probation, during which time 300 hours of community service is to be provided to the Southern Florida Water Management or Environmental Agency, at the direction of the probation office.

Federal Fines: $0; Special Assessment: $50; Restitution:  $16,829.88; Community Service: 300 hours; Probation: 36 months
